General Terms & Conditions (T&Cs) - charter cruises of Museumsschiff OESTERREICH GmbH
1. Scope of application
The General Terms & Conditions regulate the legal relationships between Museumsschiff OESTERREICH GmbH and its passengers. They are part of the contract for booking the entire ship.
2. Admission / opening times
Unless otherwise agreed, boarding begins 15 minutes before departure. Mooring and casting off in ship traffic can result in slight delays.
Throughout the season (May to September), the office is open Monday through Friday from 8:00 a.m. to 5:00 p.m. and on Saturdays from 9:00 a.m. to 12:00 noon. Out of season, the office is open Monday to Friday from 8:00 a.m. to 4:00 p.m.
3. Client
The client shall be whoever signs the contract. Signing on behalf of third parties is not possible. The client is liable.
4. Charter prices
The charter price is based on the travel times and/or services actually used. There is a flat rate for up to 140 people. A fixed price is calculated for each additional person.
5. Gastronomic services
a) Number of people
Museumsschiff OESTERREICH GmbH can only offer as many seats as are available below deck. After consultation with the client, the event takes place on the upper deck in good weather, and only below deck in bad weather. Special agreements are made on an individual basis. Museumsschiff OESTERREICH GmbH can only guarantee that the journey will run smoothly if the client complies with the contractually stipulated number of people in advance. If the number of people increases without prior written confirmation from Museumsschiff OESTERREICH GmbH, it cannot be guaranteed that sufficient food and drinks will be available. The final number of people must be communicated to Museumsschiff OESTERREICH GmbH in writing at least three days before the trip.
Due to the limited possibilities on board, it is not possible to prepare special menus during a trip at short notice. Peculiarities regarding intolerance, allergies, vegetarian food or similar must be reported to Museumsschiff OESTERREICH GmbH office no later than three days before the trip. The kitchen will be happy to take this into account. Reports regarding the meal submitted later than this, especially on the day of the trip or during the trip, cannot be taken into account.
b) Capacity limits
Depending on the number of people, different variants for the gastronomic services are possible.
Buffet / flying buffet: p to max. 85 people
Menu: up to max.
Aperitif / snacks: up to max. 140 people
Any deviating agreements must be made in writing with Museumsschiff OESTERREICH GmbH.
c) Billing of food and beverages
The drinks consumed will be charged according to consumption. The bottle price will be charged for bottles already opened.
All registered meals will be charged, even if fewer people have travelled than registered.
d) Third-party caterers / third-party providers
Bringing food and/or drinks by a third-party caterer is not permitted. Exceptions must be discussed with Museumsschiff OESTERREICH GmbH and confirmed in writing by the latter. In this case, service fees are charged.
6. Cancelling a trip
If the client cancels a trip, the following cancellation fees shall arise:
or cancellations made more than 6 months before the travel date: free of charge
for cancellations up to 6 months before the travel date: 20% of the estimated charter price
for cancellations up to 5 months before the travel date: 30% of the estimated charter price
for cancellations up to 4 months before the travel date: 40% of the estimated charter price
for cancellations up to 3 months before the travel date: 50% of the estimated charter price
for cancellations up to 2 months before the travel date: 75% of the estimated charter price
for cancellations up to 1 month before the travel date: 100% of the estimated charter price
If necessary, inquire with your insurance company about the possibility of a charter resignation insurance.
7. Notification of music usage
Notification of music usage Clients must notify AKM Austria themselves directly (at www.akm.at) of their intentions to use music groups, music or similar, and must bear the costs incurred.
8. Payment terms
A deposit of 50% of the agreed charter rate is due upon conclusion of the charter contract. Invoices for the outstanding balance are issued after the trip, unless otherwise agreed. The feedback from the captain and/or skipper regarding the charter duration, number of people, dead mileage and idle periods after the trip is a key invoicing factor.
Payment is free of charge by bank transfer to one of the three country accounts of Museumsschiff OESTERREICH GmbH. A payment term of 14 days from the invoice date shall apply. If the payment deadline is not met, a payment reminder will be sent to the billing address provided. After the third reminder, we then hand the matter over to a lawyer.
9. Cancellation policy
If a trip has to be cancelled due to circumstances beyond our control such as storms, floods, accidents or machine damage, Museumsschiff OESTERREICH GmbH assumes no liability for consequential costs of the customer such as hotel accommodation, travel costs or the like. On the other hand, any payments already made to Museumsschiff OESTERREICH GmbH will of course be reimbursed.
Museumsschiff OESTERREICH GmbH reserves the right to refuse inquiries and also to cancel trips at short notice if the character of the trip is detrimental to the image of Museumsschiff OESTERREICH GmbH.
10. Miscellaneous
Guests are not permitted to bring bicycles with them.
Strollers can be brought on board, but must be left at the entrance.
Wheelchairs can be taken on board, but the ship is not generally barrier-free due to its historical design.
Animals are not allowed.
Unless otherwise specified, there is no dress code. The heel contact surface area for shoes must be at least 2 x 2 cm.
Smoking in the salons is strictly prohibited and is only permitted on the upper deck.
Dancing is possible on board the MS OESTERREICH provided this has been arranged beforehand.
11. Lost property
Museumsschiff OESTERREICH GmbH does not accept any liability for items left on board that cannot be found after the trip.
Lost property can be handed over to the personnel on board or in the Museumsschiff OESTERREICH GmbH. office.
Lost items can be reported in the office. Once the items have been found, they can be picked up there or, depending on the type of item, sent for a shipping fee.
12. Disclaimer
Parents will be held liable for their children. Museumsschiff OESTERREICH GmbH assumes no duty of supervision on board.
Museumsschiff OESTERREICH GmbH assumes no liability for cloakrooms. These include items of clothing, shoes, umbrellas and strollers. For safety reasons, umbrellas cannot be taken into the passenger area and must be returned to the on-board staff. If you would like separate storage for a particularly valuable item, please let our staff know. However, no liability can be assumed here either. The client shall be liable for damage to the ship, the facilities or buildings caused by him/her or his/her guests.
13. Right to refuse entry
Guests can be refused entry if there is reasonable reason to believe that they will interfere with the trip or bother other visitors. Access can also be refused if the guest has not previously complied with the Terms & Conditions.

14. Public cruises
The present terms and conditions apply only to charter cruises, but not to public cruises. The Terms & Conditions for public cruises can be found on the homepage at www.ms-OESTERREICH.eu under the menu item "Cruises / Terms &Conditions" or inquire at the Museumsschiff OESTERREICH GmbH office.
15. Applicable law and jurisdiction
Austrian law shall apply. The legal domicile is the court with territorial or substantive jurisdiction for A-6971 Hard.
